About the Team

The Enforcement Team aligns with the Commission’s provider supervision and regulatory models, conducting investigations into alleged serious non-compliance with the Aged Care Code of Conduct and other conditions of registration relating to regulated entities (registered providers, responsible persons and aged care workers) obligations under the Aged Care Act 2024 and the Aged Care Rules 2025. The team focuses on enforcing compliance through various regulatory actions to hold providers and workers accountable for their conduct.

The Investigator provides support and assistance to complex investigations, focusing on serious non-compliance with relevant legislative provisions. These investigations may result in the making of significant administrative decisions and/or briefing for civil litigation (in particular, applications for civil penalties).

Working within the Enforcement Team, the Investigator must approach their duties with sensitivity, recognising that individuals accessing Commonwealth funded aged care services are among the most vulnerable in the community. The role involves dealing with potentially confronting and distressing material with professionalism and empathy.

The role includes field-based duties that involve travel and overnight stays to undertake activities in varied locations across the country. The incumbent may be appointed as an Authorised Commission Officer (ACO) and exercise regulatory powers under the Aged Care Act 2024, subject to meeting all statutory and eligibility requirements. The regulatory powers and appointment of an ACO are governed by the Aged Care Act 2024.

Position Duties

Under direction, support and contribute to complex investigations into the conduct and suitability of registered providers of aged care, aged care workers and responsible persons, ensuring accountability and quality in administrative, civil, and other enforcement responses.

Recognise the care needs of aged care recipients during investigations and support care recipients’ participation through well-structured interviews, detailed statements, affidavits, and comprehensive evidence collection.

Collect, manage, and securely maintain evidential material and protected information obtained through investigations and monitoring activities, ensuring compliance with legislative standards.

Handle sensitive and potentially distressing material with professionalism and empathy, maintaining emotional resilience and contribute to investigative activities with a focus on the well-being and dignity of everyone involved.

Prepare investigation reports to inform regulatory responses and support decision making on remedial actions and assist in the preparation of evidence briefs to facilitate civil penalty proceedings in the Federal Court.

Communicate effectively by anticipating other parties' perspectives, presenting positions effectively and resolving moderately complex to complex matters, including advocating for enforcement outcomes based on evidence and engaging with stakeholders to achieve agreeable outcomes.

Establish and maintain productive stakeholder relationships with external agencies and relevant authorities to support enforcement activities.

Utilise a well-developed understanding of statutory, regulatory and policy frameworks including the Aged Care Act 2024, the Aged Care Rules 2025 and Regulatory Powers (Standard Provisions) Act 2014 and the appropriate application of Commission powers, to contribute to investigations and provide informed advice on investigative matters.

Provide support to Senior Investigator by collaborating with legal officers and other advisors in developing compliance and enforcement responses, and act as a liaison with external counsel on enforcement matters, engaging Legal team as required.

Contribute to the continuous improvement for processes, guidance and technology for the team.

Hold or be eligible to obtain, appointment as an Authorised Commission Officer (ACO) to undertake field-based duties, subject to meeting all statutory and eligibility requirements.

Position Eligibility Requirements (Selection Criteria)

To be successful in this role you will need to demonstrate the following:

Proven ability to support and assist complex investigations, ensuring accountability and integrity and achieving quality outcomes.

Sound understanding of, or the ability to quickly acquire of, aged care legislation, statutory, regulatory, and policy frameworks including the Aged Care Act 2024, Aged Care Rules 2025 and Regulatory Powers (Standard Provisions) Act 2014.

Sound knowledge of contemporary investigations methodologies, practices, and experience in undertaking investigations including conducting interviews and preparing statements and affidavits.

Demonstrated ability to apply sound communication and interpersonal skills to engage confidently in difficult conversations, managing sensitive issues with respect, clarity, and productive outcomes.

Well-developed written communication skills to produce clear, accurate, and high-quality reports and briefs that support regulatory and enforcement objectives.

Demonstrated ability to manage confidential and protected information and evidence with accuracy and confidentiality, ensuring processes align with relevant policies, procedures and obligations.

Ability to handle sensitive and potentially confronting and distressing material with professionalism and empathy.

Ability to work under limited direction, demonstrating sound judgement through research, problem-solving, and evidence-based decision making to achieve quality outcomes.

Ability to identify and contribute to opportunities for continuous improvement, supporting change initiatives while maintaining a positive and collaborative team environment.

Ability to collaborate effectively, negotiate, and build productive working relationships with a range of stakeholders to achieve operational goals and support the Commission’s strategic objectives.

Ability to obtain Authorised Commission Officer approval in line with Commission policy and to meet obligations in respect of statutory powers, suitability requirements and responsibilities associated with field-based duties, including any travel.

Role Specific Requirements

Required to provide evidence of seasonal influenza and COVID-19 vaccinations

Ability to undertake local and interstate travel when required.

Mandatory qualifications

Certificate IV in Investigations or an equivalent qualification in law enforcement, legal or other regulatory fields (Professional Services).

Desirable skills and experience

Understanding of the Australian aged care system and the regulatory legislation, statutory, regulatory, and policy frameworks.

Experience in civil litigation seeking regulatory outcomes.

Experience working in a regulatory environment or aptitude to do so.
